MEMBERSHIP TERMS & CONDITIONS
This agreement commences once you have indicated your acceptance in the Declaration section of the web sign up process.
In some locations you can choose to delay the start date of your membership by up to 1 month. If you want to bring this date forward, please contact us at info@wembleyfitness.co.uk and we will be more than happy to discuss your options. Please do note, however, that the terms in the Money Back Guarantee section of these terms may then apply in that situation.
This agreement will become binding on you and us when we contact you to confirm your membership application has been accepted, at which point a contract will come into existence between you and us.
You will be entitled to all the rights and privileges set for the Type of Membership chosen at Wembley Fitness gym.
You cannot transfer this agreement to anyone else
RECURRING FEES AND CHARGES
The Joining Fee (if one is payable) and first month's membership fees are collected from you by us either by Debit / Credit card at time of purchase. Joining fees are applied to cover the initial administration costs associated with setting up a new membership and subscription agreement and entitle the member to an induction session, bookable online.
If you are looking to upgrade your membership there may be an admin fee charged at the point at which you upgrade.
Your second recurring payment for monthly membership fees only will be collected one month after you joined. Subsequent payments for monthly membership fees will be collected monthly from your chosen card thereafter. Each payment made is not refundable under any circumstances.
If any payment is unsuccessful or declines, we will reattempt the payment or if any other form of payment is not honored for whatever reason, despite us having notified you of a missed payment, further payments are missed, we reserve the right to, at our sole election, either suspend or terminate your membership, without any notice.
You agree to advise us immediately of any change to the Members Details provided.
MEMBERSHIP FREEZE POLICY
Your membership can be placed on freeze for a maximum of 30 days. After this period, your membership will automatically reactivate and return to your regular monthly rate. Please note, the freeze option is available only for monthly memberships and begins from the date of request. If you require an additional freeze period, it can be extended for a one-time administrative fee of £5.
To request a membership freeze, please email info@wembleytfitness.co.uk. Ensure that you allow 5 working days for the request to be processed.
MEMBERSHIP PRICES
From time to time, we may need to increase the price of membership. We will give you at least 1 full months' notice of any incoming price increase and will make it very clear when the price increase will take effect and how much your membership will cost after the increase. During this period, you will have your usual right to terminate your membership in accordance with the membership terms and conditions and rules. If you do not terminate the membership by the date given to you in the notice, then the price of your membership will be increased in accordance with our notice.
TERMINATION
MONTHLY MEMBERSHIPS
You may terminate your membership at any point as long as you give us one months' notice and clear any balance on your account. You can do this in your Wembley Fitness gym App or via email to info@wembleyfitness.co.uk, Please call Member Services for options available to you or for any further information.
In the above circumstances your membership will remain in force until the day before your next payment is due, at which point it will automatically terminate.
PAID IN FULL MEMBERSHIP
Refunds or cancellations for fixed-term memberships are not available unless accompanied by a doctor's note.
ENTRANCE ABUSE POLICY
Your Fob / Access Device (defined below) can only be used by you: Your Fob / Access Device is added on the system solely for your use, as your membership is personal to you and only covers your use of a gym.
Access is monitored: In the interests of the safety and security of all our members, access is monitored and individuals using Fobs / Access Devices may be asked to provide proof of identification.
What we will do if we think your Fob / Access Device has been misused: Should we believe that you have allowed another individual or individuals to enter behind you after you have opened the door we may (in our discretion) decide to conduct an investigation. If we do so we will: (a) inform you, via email, that we believe your Fob / Access Device has been used by another individual or individuals and ask you to provide us with reasonable assistance to investigate the matter; and (b) following our investigation we will contact you, via email, to inform you of our findings and our proposed course of action, which may include one or more of the steps set out in paragraph 4 below.
Our Right to make additional charges and/or cancel your membership: If you unreasonably refuse to cooperate with our investigation, or following our investigation we have reasonable grounds to believe that your access was misused, with or without your knowledge and/or consent, by another individual or individuals, depending on the particular circumstances of each case, we reserve the right to take one or both of the following steps, which are in addition to any other legal rights that we may have : (a) to apply a penalty charge to your membership fees (and increase your direct debit payment(s) accordingly). The penalty charge will be calculated as being equal to the daily membership charge (that applied at the time of use) for each occasion on which your access was used by that individual/those individuals; and/or (b) in the event of serious misuse of your access, for example, you have allowed individuals to enter with you on repeated occasions and/or by more than one individual, to notify you, via email, that we are cancelling your membership with immediate effect, and no refunds will be given.
Your responsibility for another’s conduct: If we have reasonable grounds for believing that you knowingly provided Access to another individual or individuals, or allowed unauthorised entry following your entry to the gym (Known as tailgating) in addition to our rights referred to in paragraph 4 above, we may hold you responsible for the conduct of the individual(s) while on our gym premises, and liable for any loss we suffer as a consequence of that conduct.
Access Device: the device, key-fob, or any other relevant security hardware device with built-in authentication equipment, issued or otherwise provided to you by us to enable you to securely access the relevant gym in accordance with the terms of your membership. Only one device can be registered to an account at any time, if you lose or misplace the device you need to contact member services to remove the device immediately.
DAILY MEMBERSHIP TERMS & CONDITIONS
PRINCIPAL TERMS
This daily membership at Wembley Fitness gym commences once you have indicated your acceptance in the Declaration section of this web sign up process.
Your membership will be activated on the date you specified, running till midnight of the specified date.
You will be entitled to all the rights and privileges exercisable for the Type of Membership chosen.
You cannot transfer this daily membership to anyone else nor transfer to another date.
Day passes are non-refundable.
FEES AND CHARGES
You shall be entitled to cancel your daily membership the earlier of: (1) 14 days after the date of purchase; If you cancel during this period, you will receive a full refund. After this period the daily membership fee is not refundable.
GENERAL TERMS & CONDITIONS
MISCELLANEOUS TERMS
Members must be 16 or older.
You agree to comply with the Rules of Membership which are displayed prominently in the Club and relate to opening hours, use of facilities and your conduct. We may make reasonable changes to these Rules at any time provided that we give you advance notice of the change.
If we take no action or let you off any breach of this agreement or give you extra time to pay or comply, it will not stop us enforcing the terms of this agreement strictly at a future date. We may assign the benefit of this agreement and our rights thereunder to a third party on notice to you. Your rights under this agreement will not be prejudiced.
There may be occasions where we have to close all, or part of, the gym of which you are a member. We will do our best to let you know of such closures in advance of them taking place, unless the problem is urgent or an emergency. We will use all commercially reasonable endeavours to ensure that such closures are outside of peak visiting hours and are kept to a minimum, in both duration and frequency. You will not be entitled to a refund of part of, or all of, your membership fees in such circumstances.
We will not be liable or responsible for any failure to perform, or delay in performance of, any of our obligations under these terms that is caused by any event that is outside of our reasonable control.
We will not be liable or responsible for outstanding monies paid to a Personal Trainer. Personal Training is arranged directly with the PT and not with Wembley Fitness.
As a consumer, you have legal rights in relation to any services that are not carried out with reasonable skill and care, or if the materials we use are faulty or not as described. Advice about your legal rights is available from your local Citizens' Advice Bureau or Trading Standards office. Nothing in these terms will affect these legal rights.
This agreement is governed by English Law.
We may terminate this agreement with immediate effect on notifying you if you are in breach of the Clubs Rules.
To the best of your knowledge and belief you are in good health and not knowingly incapable of engaging in either active or passive exercise and that such exercise would not be detrimental to your health, safety, comfort, wellbeing or physical condition. Further, that you will advise us immediately should your circumstances change.

RULES ON SAFETY & HYGEINE
By visiting Wembley Fitness gym, you are agreeing to the following rules
You must:
Not visit the gym if you are showing any symptoms of Covid-19 or live with anyone showing symptoms or who has the virus
Follow the social distancing guidelines at all times while in the gym
Wash or sanitise your hands thoroughly on entering the gym and regularly while in the gym
Wipe down kit once you have used it with the cleaning products provided. Cleaning stations and wipes are available in the gym for you to use
Not drink directly from the water fountain, this is to fill water bottles only
Failure to comply may result in you being asked to leave the gym.
GENERAL GYM RULES
Enter alone using your Fob every time you visit Wembley Fitness gym. As it’s personal to you, please don’t let anyone else enter with you or we’ll have to suspend your membership. We monitor Access by CCTV 24/7 to ensure the safety of our members and misuse may result in us applying additional charges to your membership fees. For full details of our Access Policy please refer to your Membership Terms and Conditions above.
On joining all members are offered a comprehensive induction to instruct you on the use of the gym equipment. You are strongly advised to undertake this. Wembley Fitness will not accept any liability for any claim for personal injury if you use the gym equipment having not undertaken an induction from a qualified member of staff.
Induction bookings can be made via the members area on the Wembley Fitness gym website. If you are unsure as to how to use any piece of equipment you must seek advice from a qualified member of staff before use such equipment.
For safety reasons, bags are not permitted onto the gym floor and correct attire must be worn when exercising i.e. suitable comfortable exercise clothing and appropriate footwear. Clothing such as jeans, boots, flip-flops/sandals or work wear are not permitted. Football tops may also not be deemed appropriate in the gym. Any member not wearing suitable attire may be asked to leave the gym.
You may not use the gym whilst under the influence of alcohol, narcotics, tranquilizers or any medication or other substance which may affect your ability to exercise safely. Wembley Fitness gym reserves the right to remove you from the premises if it reasonable believes you are unfit to use the facilities.
Can you ensure that you put your weights back in their original place when finished, failure to do so may result in your membership being terminated.
Please do not misuse the weights by dropping them on the floor, failure to do so may result in your membership being terminated.
Please do not take photographs/videos on the premises or post remarks to the internet that may identify another member.
You must not behave in an aggressive, abusive, anti-social or threatening manner to any staff or member, any one doing so will have their membership terminated immediately and Wembley Fitness reserves the right to contact the Police if deemed necessary.
Only Wembley Fitness licensed personal trainers are permitted to train members in the Gym unless granted express permission in writing from Wembley Fitness gym. Anyone else undertaking members’ training will be asked to leave the gym immediately.
Members are solely responsible for their own belongings whilst visiting Wembley Fitness gym. Wembley Fitness gym accepts no responsibility for any loss or damage to personal property.
Members are asked to only use the lockers for the duration of their training session. Lockers will be emptied at night and members items removed to lost property. Padlocks may be broken to gain access and will not be replaced by Wembley Fitness.
Although we will always endeavour to return any articles of lost property to the owner, we do not take responsibility for any item held in lost property. Such items will be kept until claimed, but for no longer than one week after which time the items will either be donated to charity or destroyed.
The Changing Rooms will not be available for use between the hours of 11 p.m. and 6 a.m.
Members must inform Wembley Fitness gym of any change of contact and email address or telephone numbers. These changes can be made in the Members area of the Wembley Fitness gym app/website.
By accessing the gym and using the gym equipment members are deemed to have read and understood the terms and conditions of membership.
Should your Physical Activity Readiness Questionnaire result in you being required to discuss your intention to exercise with your doctor, please be aware that your subscription remains active and any fees collected are non-refundable.
Smoking, including e- cigarettes are strictly prohibited in all areas of the gym. Any member found to be breach of this rule may have their membership terminated.
Members may not bring any pets (other than official aid dogs) into the gym.
CLASS BOOKING RULES
Members must arrive promptly for class start times; late arrival may result in being refused entry to the class.
Members are recommended to book in advance to ensure that a class has space for them.
Members can book online from 10 days in advance.
Wembley Fitness operates with a “three strikes” non-attendance rule, whereby three no-shows within a 28-day rolling period will result in a 14-day booking ban. Any future classes you have booked will also be cancelled. You must cancel your class at least 24 hours before it starts or this will be recorded as a no show and will be charged in full .
Our classes get full. If a member is unable to attend, they should cancel in advance of the class to avoid receiving a strike. If a class is full a member can book onto a waiting list. An app notification will be sent confirming the members place on the waiting list.
Members with extenuating circumstances impacting their ability to attend classes should contact Member Services for free cancellation.
Free day trial
Complimentary Day Pass Terms and Conditions:
The free day pass is exclusively available to individuals residing in or near Wembley, specifically within the following postcodes: HA0,HA1,HA3,HA4,HA7,HA8,HA9,NW2,NW9 and NW10. To redeem, clients must download the voucher onto the App and present it upon arrival.
Availability is subject to discretion of the Club Manager.
Pass holders are required to bring photo identification along with proof of address to their appointment.
The complimentary day trial does not include any paid activities such as treatments, health MOT, sessions with a physiotherapist or wellbeing advisor, and paid-for classes.
Only one free day trial per person is allowed, and it is applicable for first-time visitors only. Subsequent day passes will be charged at the standard guest pass rate.
Participants must be a minimum of 18 years old.
Guests over 18 can be invited to the club, but they are required to pay a fee for access to the facilities. Details of these fees can be obtained at the club. Guests must sign in at the club's reception and complete an exercise questionnaire at the beginning of each visit.
There is no cash alternative available.
These terms and conditions do not serve as the free pass itself and cannot be used to claim a free pass.
Wembley Fitness reserves the right to terminate or modify this promotion at any time.
